Terms and Conditions of Use, Disclaimers, and Privacy Policy
Construction Safety Software Corporation and its subsidiaries and affiliates ("Construction Safety Software Corporation," "CSSC" "We," "Us" or "Our") created this Terms
and Conditions of Use, Disclaimers, and Privacy Policy Agreement (the "Terms of Use") to clarify how visitors to Our internet site located at www.csscsystems.com (the
"Web Site", "Site") may use this Site.
This agreement describes the terms on which We permit use of the Web Site. These Terms of Use govern all use of the Web Site and apply to all Internet traffic visiting
the Web Site (called "Users" or "You"). Before using the Web Site, please read all of these Terms of Use carefully as Your use of the Web Site constitutes Your acceptance
of these Terms of Use. If You do not agree to these terms, You may not use the Web Site.

trade secrets, confidential or proprietary information, or use trademarks or service marks in an infringing fashion.
The data housed at www.csscsystems.com has been compiled primarily as a service to our clients in the Construction field and county, state and federal government agencies.
The data and forms used herein are based on requirements set by the various governmental agencies and custom and practice in the construction industry and in particular
construction safety. All information shown is for the forgoing purpose, and no liability is assumed for the accuracy of the data delineated herein. The information, forms and data available on www.csscsystems.com are provided "as is" without any warranty or any representation of accuracy, timeliness or completeness.
The burden for determining accuracy, completeness, timeliness, merchantability and fitness for or the appropriateness for use rests solely on the User accessing this information.
The Construction Safety Software Company makes no warranties, expressed or implied, as to the use of the forms, information or data available on www.csscsystems.com. There
are no implied warranties of merchantability or fitness for a particular purpose. The user acknowledges and accepts all inherent limitations of the forms, information and other
data.
The forms, data and other information are dynamic and in a constant state of maintenance, correction and revision. Although the forms, data and other information are updated on a
regular basis they may not be completely updated or in compliance with governmental requirements at the time of your use. Recent law or rule or other changes may not yet be
incorporated in the forms or other data on the Site. No liability is assumed for the accuracy of the forms information or data on this Site, either expressed or implied.
CSSC MAKES NO WARRANTY THAT ANY DEFECTS, WHETHER KNOWN OR UNKNOWN, WILL BE CORRECTED, OR THAT THE WEB SITE WILL BE VIRUS-FREE.
Every attempt will be made to ensure that CSSCSYSTEMS.com is available to our subscribers 24 hours per day, 7 days per week. However, occasional disruptions in service are
inevitable and often beyond our control.Therefore, we cannot guarantee that www.csscsystems.com will be operational at any given time and You agree that CSSC will not be liable
to you or any third party for any loss or cost incurred by You as a result of the Site not being operational at any point in time. In the event CSSC is found liable to You for
any reason CSSC will be liable only for the return of Your monthly payment to CSSC for the last month You accessed the Web Site and not for consequential damages or loss of
business or opportunity. CSSC will not be liable in any amount for failure to perform, or delay in performing, any obligations, hereunder if such delay or failure is caused by
any events beyond Our control including, without limitation, acts of third parties, wars, hostilities, revolutions, riots, civil commotion, national emergency, if suchstrikes,
lock-outs, unavailability of supplies, epidemics, fire, flood, earthquake, force of nature, explosions, embargo, or any other Act of God, unavailability, errors or other failures
on the Internet, other data networks, or telecommunications systems, any law, proclamation, regulation, ordinance, or other act or order of any court, government or governmental
agency or delays. These Terms of Use will be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflicts of laws provisions.
The application of the United States Convention of Contracts for the International Sale of Goods is expressly excluded. The exclusive personal jurisdiction of and venue for all
disputes arising out of these Terms of Use and Your use of the Web Site and/or the services provided thereby shall be the state and federal courts located within the State of
Illinois and You consent to such jurisdiction and waive allobjections to such jurisdiction and venue.
Subscription Access Use:
You agree that Your right to use the online access to www.csscsystems.com material is subject to the following conditions:
* A subscription agreement grants you the right to use the information provided on www.csscsystems.com for your own use only. You agree to use such information in accordance
with all applicable laws and regulations. You agree that the information provided on www.csscsystems.com will not be duplicated, copied, sold, used by any other person, firm or
corporation, or made otherwise available to any third party except for use in accordance with your subscription as allowed herein. You also agree not to deep-link or Hack into
the Site for any purpose, unless specifically authorized by US to do so. Illegal and/or unauthorized use of the Web Site, including but not limited to, unauthorized framing of
or linking to the Web Site, or any part of the Web Site, or unauthorized use of any devise or program on the Web Site, will be investigated and We will take appropriate legal
action, including but not limited to, civil, criminal, and/or injunctive redress. YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD CSSC, ITS OFFICERS, DIRECTORS,
EMPLOYEES, AGENTS, INDEPENDENT CONTRACTORS, LICENSEES, AFFILIATES, DISTRIBUTORS, RESELLERS AND MARKETING REPRESENTATIVES HARMLESS
FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES, LIABILITIES AND COSTS INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEY FEES
AND COURT COSTS (COLLECTIVELY, THE "CLAIMS") ARISING OUT OF OR RELATING TO YOUR BREACH OF ANY OF THESE TERMS OF USE OR USE BY YOU
OF THE WEB SITE, EXCEPT TO THE EXTENT SUCH CLAIMS DIRECTLY RESULT FROM CSSC'S OWN NEGLIGENCE. THIS INDEMNIFICATION OBLIGATION SHALL
SURVIVE ANY TERMINATION OF THESE TERMS OF USE OR OF THE WEB SITE OR THE SERVICES PROVIDED THEREBY.
* Users also agree that the user name(s) and password(s) for their account group type will not be sold, shared, or otherwise broadcast to any third party outside of their account
group or physical location. The Site provides a mechanism for You to access Your passwords or log in information when they are lost by You so that you may access the Site.
In the event you believe someone else has obtained access to Your password or log in information You must notify Us immediately. We will not be liable to You or any third party
for a third parties access to Your data stored on Our Web Site or for any loss or damage to that data for any reason.
* An access agreement is to be in full force for the duration of your subscription. Account abuse and/or non-compliance with the agreement will result in automatic termination or
suspension of online access to www.csscsystems.com. The Construction Safety Software Corporation retains the right of final determination to allow or disallow access to the
information provided on www.csscsystems.com. Upon termination or suspension of Your account, whether for nonpayment or otherwise, You may not utilize the Site or access the
data stored on the Site.
* All information, data, forms and their related images presented on www.csscsystems.com carry the same copyright as our printed publications. Therefore, retransmission,
duplication, or inclusion of these images via any other source is prohibited unless prior written consent of The Construction Safety Software Corporation has been granted.
Reproduction or storage of materials retrieved from this Web Site is subject to the U.S. Copyright Act of 1976, Title 17 U.S.C. You may not use, distribute, reproduce, publish,
transmit, transfer, sell, create derivative works from, or in any way exploit the content. Any trademarks or service marks appearing on this Web Site are the property of CSSC
or their respective owners. Subscribers are permitted to use small portions of images for internal presentation purposes only or for required filings with governmental agencies
as provided for in the normal operation of the site. Any abuse of these copyrights will not only be a reason for termination of services but offenders will also be held liable
for such infringements. Any trademarks or service marks appearing on this Web Site are the property of CSSC or their respective owners. You and CSSC are Independent
Contractors and no agency, partnership, joint venture, employer-employee or franchiser-franchisee relationship is intended or created by the Terms of Use. Privacy Policy You
may be required to provide Us with certain information when using the Web Site. You agree that the information You provide will be true and accurate. You consent to Our
verifying any information that You provide. Here's how We collect and use information from You:
* An IP or "Internet Protocol" address is a number that is automatically assigned to Your computer whenever You're surfing the Internet. Web servers automatically identify
Your computer by its IP address. Your IP address and other site usage data are used to gather broad demographic information. This data helps Us serve You by allowing Us to
understand how visitors use our Web Sites. We normally do not link IP addresses to anything personally identifiable, which means that a Customer's session will be logged,
but the Customer remains anonymous to Us. We can and will use IP addresses to identify a Customer when We feel it is necessary to enforce compliance with Our Terms of Use
or to protect Our service, Web Site, customers or others.
* Our Sites does not use a technology called "cookies," which are small files stored by Your browser to help keep track of Your user profile.
* Our Web Site includes registration forms that require Users to give Us contact information (like Your name), unique identifiers (like Your email address), and demographic
information (like Your Zip code). We use contact information from registration forms to send You information related to Our products and services. Your contact information

prospective customers. These Discussion Groups, Events Calenders, Academic Corner, Message Boards, Directions, and Project and Subproject Names cover a wide range of
topics. You should be aware that information disclosed in these portions of the Site is made available to all subscribers and in some cases to anyone coming to the Site and
thus becomes public information. You should exercise caution when deciding to disclose any information.
* We may survey Users for contact information, unique identifiers and demographic information. You are never required to answer these questions. The information You submit
may be used for analyzing overall site demographics, preferences and tastes, and similar "getting to know Our customers" purposes. We may disclose this data to third

features, products, policies, promotions, disclosures and disclaimers on the Website at any time. Please check the policy periodically for changes. The continued use of the
Website following the posting of changes to this Privacy Policy will mean you accept those changes. Except as explicitly stated otherwise, (i) all notices to Construction
Safety Software Corporation shall be made by postal mail to Construction Safety Software Corporation, 153 Larchmont Lane, Bloomingdale, Illinois 60108 Attn: Legal
Department and (ii) all notices to You shall be made by postings to Our Web Site. Alternatively, we may give you notice by sending an email to the email address You
provided us when registering. In the case of email, notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address
is invalid. In the case of postal mail, notice shall be deemed given 3 days after the date of mailing.
If any provision of these Terms of Use as such may exist or may hereafter be amended, is found to be invalid, illegal or unenforceable for whatever reason, such provision
shall be fully severable and the other remaining provisions shall remain in full force and effect, and shall be construed as if the illegal, invalid or unenforceable provision
never comprised a part thereof. Furthermore, in lieu of such invalid, illegal or unenforceable provision there shall be added automatically in its place a provision similar in
its terms and intent to the illegal, invalid or unenforceable provision as may be possible and be legal, valid or enforceable. Any failure of CSSC to enforce any provision of
these Terms of Use shall not be construed a waiver of any rights under such provision or any other provision of the Terms of Use. CSSC may only make such waiver by an
express writing. Any rights or obligations granted to You hereunder may not be assigned or transferred to any other person or entity. These Terms of Use constitute the sole
agreement between CSSC and You regarding the subject matter contained herein and fully supercede any and all other understandings or agreements, whether oral or written.
You acknowledge and agree that You have read and understand these Terms of Use and agree to be bound by them.
About Pop-Up and Pop-Under Windows
The Construction Safety Software Corporation does not condone or authorize the use of any commercial pop-up or pop-under windows to be delivered during access to the
www.csscsystems.com Site. If you are experiencing any of these commercial advertising windows (such as casino sites, adult rated sites, ect.) they are being launched from a
previously viewed website or search engine. The only form of a pop-up window you may expect to experience on our site will be for an enlargement of a detail image or company
related instructions.
