Construction Safety Software Corporation and its subsidiaries and affiliates ("Construction Safety Software Corporation," "CSSC" "We," "Us" or "Our") created this Terms

and Conditions of Use, Disclaimers, and Privacy Policy Agreement (the "Terms of Use") to clarify how visitors to Our internet site located at www.csscsystems.com (the

"Web Site", "Site") may use this Site.

The data and forms used herein are based on requirements set by the various governmental agencies and custom and practice in the construction industry and in particular

construction safety. All information shown is for the forgoing purpose, and no liability is assumed for the accuracy of the data delineated herein. The information, forms and data available on www.csscsystems.com are provided "as is" without any warranty or any representation of accuracy, timeliness or completeness.

The burden for determining accuracy, completeness, timeliness, merchantability and fitness for or the appropriateness for use rests solely on the User accessing this information.

to you or any third party for any loss or cost incurred by You as a result of the Site not being operational at any point in time. In the event CSSC is found liable to You for

any reason CSSC will be liable only for the return of Your monthly payment to CSSC for the last month You accessed the Web Site and not for consequential damages or loss of

business or opportunity. CSSC will not be liable in any amount for failure to perform, or delay in performing, any obligations, hereunder if such delay or failure is caused by

any events beyond Our control including, without limitation, acts of third parties, wars, hostilities, revolutions, riots, civil commotion, national emergency, if suchstrikes,

lock-outs, unavailability of supplies, epidemics, fire, flood, earthquake, force of nature, explosions, embargo, or any other Act of God, unavailability, errors or other failures

on the Internet, other data networks, or telecommunications systems, any law, proclamation, regulation, ordinance, or other act or order of any court, government or governmental

agency or delays. These Terms of Use will be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflicts of laws provisions.

The application of the United States Convention of Contracts for the International Sale of Goods is expressly excluded. The exclusive personal jurisdiction of and venue for all

disputes arising out of these Terms of Use and Your use of the Web Site and/or the services provided thereby shall be the state and federal courts located within the State of

Illinois and You consent to such jurisdiction and waive allobjections to such jurisdiction and venue.

Subscription Access Use:

You agree that Your right to use the online access to www.csscsystems.com material is subject to the following conditions:

* A subscription agreement grants you the right to use the information provided on www.csscsystems.com for your own use only. You agree to use such information in accordance

FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES, LIABILITIES AND COSTS INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEY FEES

AND COURT COSTS (COLLECTIVELY, THE "CLAIMS") ARISING OUT OF OR RELATING TO YOUR BREACH OF ANY OF THESE TERMS OF USE OR USE BY YOU

OF THE WEB SITE, EXCEPT TO THE EXTENT SUCH CLAIMS DIRECTLY RESULT FROM CSSC'S OWN NEGLIGENCE. THIS INDEMNIFICATION OBLIGATION SHALL

SURVIVE ANY TERMINATION OF THESE TERMS OF USE OR OF THE WEB SITE OR THE SERVICES PROVIDED THEREBY.

* Users also agree that the user name(s) and password(s) for their account group type will not be sold, shared, or otherwise broadcast to any third party outside of their account

* An IP or "Internet Protocol" address is a number that is automatically assigned to Your computer whenever You're surfing the Internet. Web servers automatically identify

Safety Software Corporation shall be made by postal mail to Construction Safety Software Corporation, 153 Larchmont Lane, Bloomingdale, Illinois 60108 Attn: Legal

Department and (ii) all notices to You shall be made by postings to Our Web Site. Alternatively, we may give you notice by sending an email to the email address You

provided us when registering. In the case of email, notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address

is invalid. In the case of postal mail, notice shall be deemed given 3 days after the date of mailing.

If any provision of these Terms of Use as such may exist or may hereafter be amended, is found to be invalid, illegal or unenforceable for whatever reason, such provision

shall be fully severable and the other remaining provisions shall remain in full force and effect, and shall be construed as if the illegal, invalid or unenforceable provision

never comprised a part thereof. Furthermore, in lieu of such invalid, illegal or unenforceable provision there shall be added automatically in its place a provision similar in

these Terms of Use shall not be construed a waiver of any rights under such provision or any other provision of the Terms of Use. CSSC may only make such waiver by an

express writing. Any rights or obligations granted to You hereunder may not be assigned or transferred to any other person or entity. These Terms of Use constitute the sole

agreement between CSSC and You regarding the subject matter contained herein and fully supercede any and all other understandings or agreements, whether oral or written.

You acknowledge and agree that You have read and understand these Terms of Use and agree to be bound by them.

About Pop-Up and Pop-Under Windows

The Construction Safety Software Corporation does not condone or authorize the use of any commercial pop-up or pop-under windows to be delivered during access to the

www.csscsystems.com Site. If you are experiencing any of these commercial advertising windows (such as casino sites, adult rated sites, ect.) they are being launched from a

previously viewed website or search engine. The only form of a pop-up window you may expect to experience on our site will be for an enlargement of a detail image or company

related instructions.

Purchase of a license to Construction Safety Supervisor is for a term of 1 (one) year to be billed monthly.

All customer data entered through the use of Construction Safety Supervisor and residing on Construction Safety Software Corporation's server is the property of Construction Safety Software Corporation. Data retrieval shall be in printed form at no cost to the customer. The customer must request such data retrieval at least 30 (thirty) days prior to the end of customer's termination of use.
